These Terms of Service (the "Terms") are a contract between you ("Customer," "you," or "your") and Hunt Labs Inc ("ByteKit," "we," "us," or "our") for your use of the ByteKit service, including the API, dashboard, SDKs, CLI, MCP server, documentation, and related services that link to these Terms (the "Service").

By creating an account, clicking to accept these Terms, signing an order form that incorporates them, or using the Service after they are presented to you, you agree to these Terms. If you accept on behalf of an organization, you represent that you have authority to bind that organization.

The Acceptable Use Policy ("AUP") and Data Processing Agreement ("DPA") are incorporated into these Terms.

1. The Service

ByteKit provides programmatic tools to fetch, render, capture, transform, store, and return web content at URLs submitted by customers. Each request you submit is your instruction to ByteKit to process that target URL.

You are responsible for deciding whether each request is lawful, authorized, and consistent with third-party terms and applicable law. ByteKit does not determine whether you have rights to access or use a target URL or Captured Content.

Features marked beta, preview, experimental, or similar are provided as-is, may change or stop at any time, and have no service-level commitment.

We may modify, suspend, discontinue, or replace features from time to time. For material reductions to generally available paid functionality, we will use commercially reasonable efforts to give advance notice unless a shorter timeline is needed for security, legal, abuse-prevention, third-party dependency, or operational reasons.

For generally available API versions, we will use commercially reasonable efforts to avoid backwards-incompatible changes without advance notice. Unless a shorter period is needed for security, legal, abuse-prevention, third-party dependency, or operational reasons, we will provide at least 90 days' notice before retiring a generally available API version.

Free, trial, promotional, preview, or evaluation access is provided as-is, without support or service-level commitments, and may be modified, limited, or terminated at any time.

2. Accounts and Credentials

You must be at least 18 years old and able to enter into a binding contract. You must provide accurate account information and keep it current.

You are responsible for all activity under your account and credentials, including activity initiated by employees, contractors, scripts, automations, AI agents, MCP clients, or other systems using your account or API keys.

You must protect your credentials, rotate keys when appropriate, and notify us promptly at [email protected] if you suspect compromise. We may suspend or revoke credentials we believe are compromised or being misused.

You may not create multiple accounts to evade pricing, quotas, rate limits, fraud controls, or enforcement.

3. Your Responsibilities

For every request submitted through the Service, you represent and warrant that:

  • You have the legal right and authority to direct capture of the submitted URL.
  • Your use complies with all applicable laws and regulations, including laws governing computer fraud, unauthorized access, anti-circumvention, privacy, data protection, intellectual property, sanctions, and export control.
  • You have obtained any consent required for personal data that may be returned or processed.
  • You are not targeting password-protected, gated, non-public, or restricted content without authorization.
  • Your use does not breach third-party terms or policies binding on you.
  • You are not using the Service for ticketing-bot conduct prohibited by the BOTS Act or similar laws.
  • You are not subject to applicable sanctions or restricted-party lists.
  • For recording requests, you have obtained any required consent from people whose content or activity appears in the recording.

A material misrepresentation is a material breach of these Terms.

4. Acceptable Use

You must comply with the AUP. AUP violations are material breaches of these Terms. We may suspend or terminate access for actual or suspected AUP violations, legal or security risk, abuse reports, target-site complaints, or other activity that may harm ByteKit, other customers, or third parties.

5. Captured Content and Third-Party Content

"Captured Content" means content, screenshots, recordings, HTML, Markdown, structured data, sitemap data, or other artifacts produced through the Service in response to your requests.

As between you and ByteKit, you own the Captured Content produced for you, subject to any rights held by the operators of target sites or other third parties. ByteKit does not claim ownership of third-party content underlying Captured Content.

You grant ByteKit a limited license to host, store, transmit, process, display, and return Captured Content as needed to provide, secure, support, and bill for the Service.

You are solely responsible for your target URLs, Captured Content, and any use, retention, distribution, or deletion of Captured Content.

6. Intellectual Property

ByteKit owns the Service, including its software, infrastructure, APIs, documentation, models, trademarks, and related intellectual property. These Terms do not grant you rights in ByteKit intellectual property except the limited right to use the Service under these Terms.

If ByteKit distributes SDKs, CLI tools, sample code, or other developer tools under an open-source license, your use of that code is governed by the applicable open-source license.

If you provide feedback or suggestions, ByteKit may use them without restriction or compensation.

7. AI and Service Improvement

By default, ByteKit may use request metadata, telemetry, usage data, and aggregated or de-identified operational data to operate, secure, analyze, and improve the Service, including fraud and abuse detection, routing, reliability, and model evaluation.

ByteKit does not use Captured Content for model training by default. If ByteKit offers a Captured Content training opt-in, it will apply only where you affirmatively opt in through a dashboard setting or written agreement, and you may withdraw that opt-in for future training use.

8. Payment

Fees are set out on the pricing page, dashboard, checkout flow, or order form. You authorize ByteKit or its payment processor to charge your payment method for fees as they become due.

Subscriptions renew automatically unless cancelled before the end of the then-current term. You may cancel through the dashboard or billing portal. Cancellation takes effect at the end of the then-current paid term unless stated otherwise.

If you enable auto-topups, usage-based charges, or threshold-triggered charges, you authorize charges when the applicable threshold or billing condition is met. You may disable auto-topups through the dashboard for future charges.

Fees are exclusive of taxes unless stated otherwise. You are responsible for applicable taxes other than taxes on ByteKit's net income.

Late amounts may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law. We may suspend or terminate access for non-payment.

Except as expressly stated in these Terms or an order form, fees are non-refundable.

9. Suspension and Termination

We may suspend access immediately if we believe your use violates these Terms or the AUP, creates legal, security, operational, reputational, or third-party risk, is the subject of abuse reports or legal process, or if payment is overdue.

Either party may terminate for convenience on 30 days' notice. We may terminate immediately for material breach, unlawful or high-risk use, non-payment, insolvency, or other cause described in these Terms.

On termination, your right to use the Service ends. Amounts accrued remain due. You may export Captured Content for 30 days after termination unless access was terminated for cause or export would create legal or security risk. After that period, Captured Content is deleted according to the DPA.

Sections that by their nature should survive termination survive, including sections on your responsibilities, payment obligations, intellectual property, confidentiality, indemnity, disclaimers, liability limits, dispute resolution, and general terms.

10. Confidentiality

Each party may receive non-public business, technical, security, product, pricing, customer, or other information from the other that is marked or reasonably understood as confidential. The receiving party will use confidential information only for this relationship, protect it with reasonable care, and disclose it only to people and service providers who need to know it and are bound by confidentiality obligations.

Confidential information does not include information that is public without breach, already known without restriction, independently developed, or rightfully received from a third party. A party may disclose confidential information where legally required, with notice where legally permitted.

These confidentiality obligations survive for three years after disclosure, except trade secrets remain protected for as long as they qualify as trade secrets.

11. Indemnification

You will defend, indemnify, and hold harmless ByteKit and its officers, directors, employees, contractors, and agents from third-party claims, losses, damages, liabilities, penalties, settlements, judgments, costs, and reasonable attorneys' fees arising out of or relating to:

  • Your use of the Service or Captured Content.
  • Your requests, target URLs, or instructions.
  • Your breach of these Terms, the AUP, or applicable law.
  • Allegations that your use involves unauthorized access, circumvention, interference with third-party systems, violation of the Computer Fraud and Abuse Act, 18 U.S.C. § 1030, the DMCA anti-circumvention provisions, 17 U.S.C. § 1201, the BOTS Act, or similar laws.
  • Allegations that your use infringes, misappropriates, or violates intellectual property, privacy, publicity, contractual, or other rights.

ByteKit will defend you against third-party claims that the Service, as provided by ByteKit and used according to these Terms, infringes a United States patent, copyright, or trademark, and will pay damages finally awarded or settlement amounts approved by ByteKit. This obligation does not apply to claims arising from your content, target URLs, use in breach of these Terms, modifications not made by ByteKit, or combinations with items not provided by ByteKit.

The indemnified party must give prompt notice, reasonable cooperation, and control of the defense to the indemnifying party, subject to reasonable settlement consent protections.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTEKIT DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, QUIET ENJOYMENT, SYSTEM INTEGRATION, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

BYTEKIT DOES NOT WARRANT THAT THE SERVICE WILL CAPTURE ANY PARTICULAR URL, BYPASS ANY ACCESS CONTROL OR ANTI-BOT SYSTEM, BE UNINTERRUPTED OR ERROR-FREE, PRODUCE ACCURATE OR COMPLETE CAPTURED CONTENT, OR BE LAWFUL OR APPROPRIATE FOR ANY PARTICULAR USE OR JURISDICTION.

Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTEKIT'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO BYTEKIT FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100.

These limits do not apply to payment obligations, your indemnification obligations, AUP violations, violations of law, infringement or misappropriation of third-party rights, fraud, willful misconduct, or liability that cannot be limited by law.

14. Force Majeure

Neither party is liable for delay or failure to perform, other than payment obligations, caused by events beyond reasonable control, including natural disasters, war, civil unrest, cyberattacks on third-party infrastructure, public internet failures, sub-processor outages, target-site changes, proxy or browser-engine issues, blocklists, or changes in law or enforcement posture.

15. Modifications

We may update these Terms, the AUP, or the DPA from time to time. We will provide notice of material changes through email, dashboard notice, changelog, or another reasonable channel. If a material change requires re-acceptance, you must accept the updated Terms before continuing to use the Service.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.

Before starting a formal proceeding, the party with a claim will provide written notice and the parties will try in good faith to resolve the dispute for 30 days.

Any dispute not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its applicable rules, on an individual basis, in New York County, New York, except that either party may seek injunctive relief in court and ByteKit may bring an action to collect unpaid fees.

YOU AND BYTEKIT EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE ACTION TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Any claim must be filed within one year after it accrues, unless applicable law prohibits that limitation.

17. General Terms

You may not assign these Terms without ByteKit's prior written consent, except in connection with a merger, acquisition, or sale of substantially all assets. ByteKit may assign these Terms.

These Terms, the AUP, the DPA, and any applicable order form are the entire agreement for the Service. If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.

The parties are independent contractors. There are no third-party beneficiaries except ByteKit indemnitees under the indemnity section.
